Submitted: June 12, 2009 Before STEELE, Chief Justice, JACOBS and RIDGELY, Justices ORDER This 16th day of July 2009, upon consideration of the briefs on appeal and the record below, it appears to the Court that: (1) The defendant-appellant, Lee Ross, filed an appeal from the Superior Court's March 9, 2009 order granting his motion for credit for time served. Ross claims that the Superior Court should have applied the credit to his current Level V sentence rather than to another suspended Level V sentence. We find no merit to the appeal. Accordingly, we affirm.
